Traffic Offences

Ontario's demerit point system assigns "points" for various offences.  Each driver has "0" points when they obtain their license.  A G2 Licensee will be called in to the Ministry of Transportation when they reach 6 demerit points and will receive a mandatory suspension at 9 points.   A G Licensee will have a review when at 9 points or over and will receive a mandatory suspension at 15 points.   Below is a list of some of the offences and their respective demerit points....

Offences under the Highway Traffic Act and their Demerit Points

The following charges receive 7 demerit points:

  • Failing to remain at the scene of a collision, Section 200(1)(a)
  • Failing to stop when signaled/requested by a police officer, Section 216(2)

The following charges receive 6 demerit points

  • Racing, Section 172
  • Careless Driving, Section 130
  • Exceeding the speed limit by 50 km/h or more, Section 128
  • Failing to stop for a school bus, Section 175(11)

The following charges receive 5 demerit points

  • Bus failing to stop at an unprotected railway crossing, Section 174

The following charges receive 4 demerit points

  • Speeding 30 to 49 km/h over limit, Section 128
  • Following too closely, Section 158(1)

The following charges receive 3 demerit points

  • Speeding 16 to 29 km/h over the limit, Section 128
  • Failing to yield right of way, Section 144(7),(8), 135(2),(3), 138(1) and 141(4)
  • Failing to report a collision to a police officer, Section 199(1)
  • Driving or operating a vehicle on a closed road, Section 134(3)
  • Crowding the drivers seat, Section 162
  • Driving through, around or under a railway crossing barrier, Section 164
  • Failing to obey a stop sign, traffic light or railway crossing, Section 136(1)(a), 144(14)-(18),(21), 146(3),(4) and 163(1)
  • Driving the wrong way on a divided road, Section 156(1)(a)
  • Improper driving when road is divided into lanes
  • Going the wrong way on a one-way road, Section 15
  • Crossing a divided road where no proper crossing is provided, Section 156(1)(b)
  • The following charges receive 2 demerit points

    • Improper opening of a vehicle door, Section 165
    • Towing people - on toboggans, skis, and the like, Section 160
    • Failing to stop at a pedestrian crossing, Section 140(1)
    • Improper right turn, Section 141(2),(3)
    • Improper left turn, Section 141(6),(7)
    • Prohibited turns, Section 143
    • Failing to signal, Section 142(1),(2) and (8)
    • Failing to share the road, Section 148(1),(2),(4),(5),(6) and (7)
    • Unnecessary slow driving, Section 132(1)
    • Reversing on a divided high-speed road, Section 157(1)
    • Driver failing to wear a seat belt, Section 106(2)
    • Driver failing to ensure that a passenger less than 23 kg is properly secured, Section 106
    • Driver failing to ensure that a passenger under 16 years is wearing a seat belt, Section 106(4)
